The proceedings relate to the following contracts, but only when entered into with small business customers:

  • Preferred Customer Rental Agreement Versions 7.1A, 7.2 and 7.3
  • Preferred Customer Rental Agreement (Interest Free Promotion) Version 7.2
  • Fixed Lease Rental Agreement Versions 7.2 and 7.3
  • Docurent Agreement Versions 7.2 and 7.3
  • Documation Agreement Versions 7.2 and 7.3
  • Fixed Term Rental Agreement Versions 7.2 and 7.3
  • Rental Agreement Versions 7.2 and 7.3
  • Purchase Agreement Versions 7.2 and 7.3
  • Support Services Agreement Versions 7.2 and 7.3
  • Software Licence and Support Services Agreement Versions 7.3 and 7.4
  • Minimum Term Rental Agreement Version 3.0
For the purpose of the proceedings, a small business is one which has less than 20 employees (including casual employees employed on a regular and systematic basis) at the time the contract was signed or amended and the upfront price payable under the contract is no more than $300,000 or $1 million if the contract is for more than 12 months.
Impacted customers will be contacted within 90 days from when the outcome to the proceedings are made public.
For small business customers on one of the Impacted Contracts, while there are clauses that we cannot rely on, the contract as a whole remains valid. We will continue to provide service and support as we do today.

Customers who are not small businesses are outside the scope of the unfair contract terms legislation. As such, their contracts continue unaffected and unchanged by the ACCC proceedings.

If a customer would like to, we are happy to move them to our new Version 8.0 contracts which we are confident present a much more balanced position for our customers.

While we are confident the Version 8.0 contracts address the concerns raised by the ACCC, the ACCC has not reviewed or approved the Version 8.0 contracts. 

Small businesses who have contracted with us using their own contract are outside the scope of the unfair contract terms legislation. Any such contracts continue unaffected.
