FUJIFILM Business Innovation New Zealand Limited and its subsidiaries, employees, officers and agents (‘we’, ‘us’ ‘our’ or ‘FBNZ’) understands the inherent responsibility of entities handling personal information. We are committed to respecting your privacy and protecting your personal information. FBNZ is bound by, and complies with, the Privacy Act 2020 (the ‘Act’), and the terms of the policy set out below (‘Privacy Policy’).
Please read this Privacy Policy carefully to understand the basis on which we collect, use and store your personal information or personally identifiable (‘Personal Information’).
Personal Information means any information that can identify you either directly or indirectly (i.e. by reference to other information we have access to), such as your name, address, email address, telephone number, and photographs and images that are provided to us.
This Privacy Policy covers all of our goods and services, including the use of our website, the use of our goods and services, including provision of credit by us to you, and all of our interactions with you. If you do not consent to the collection, use, disclosure, storage and processing of your information in accordance with this Privacy Policy, please do not access our website (“Site”) or use our goods or services. By providing FBNZ any Personal Information, you will be deemed to have expressly consented to FBNZ processing this Personal Information in accordance with this Privacy Policy.
1. How we collect your Personal Information
We collect Personal Information about you when you:
- Visit our Site (we collect information relating to your use of our Site and the content you access).
- Enter FBNZ promotions or competitions (such as your name, email address, mobile number).
- Contact us with a question, sales enquiry, query, complaint or feedback (such as your name, email address, contact phone number, address, and any Personal Information included in the message you submit to us).
- Complete application forms and order forms regarding use of our products and services.
- Use our products and services (equipment maintenance information, diagnostic logs from our devices, etc).
2. What Personal Information we collect
Personal Information is only acquired as is strictly necessary in the ordinary course of business. The types of acquisition and specific Personal Information to be acquired include:

- Business cards information of third party stored in products and services by you.

- Information of the application when linking the product / service with a third-party application
Information you send to us when responding to inquiries or troubleshooting (print data, file names, log data, photos of the device itself and parts, Error output samples, etc.)

- Information acquired and collected varies depending on products and services. Not all of above information will be acquired or obtained.
- Not all of the above information can be identified by FBNZ in connection with specific individuals.
- Information that does not correspond to Personal Information in some countries is also included.
- Please note that it is your own choice to provide Personal Information to us or not, and that you are not obliged to provide Personal Information under any statutory or contractual requirement. However, if you have chosen not to provide your Personal Information, we may not be able to provide you with specific features of the service (such as personalized recommendations based on your preferences) or in some cases, the service itself.
3. How we use your Personal Information
We may use Personal Information for the following purposes:
- Selling, promoting and providing products and services requested by you.
- Registering and handling of service calls.
- Responding to communications from you.
- Providing you with information that you request (by post, telephone or email).
- Sending you additional information on our products and services which we think may be of interest to you.
- Exchange of information, documents, etc. necessary for contracts and other procedures necessary for the use of products and services
- Provision of product and service functions and billing based on the contract
- Execution of maintenance contracts
- To check the status to maintain service level
- To provide necessary information to you, such as product and service updates, security alerts, planned maintenance, and occurrence of troubles
- Provide maintenance support by telephone, e-mail, direct visits, etc. and improve maintenance support quality
- To improve products and services and to plan and examine new products and services
- To improve the products and services themselves
- Analyse and resolve defects, problems, etc. in products and services
- To investigate and prevent unauthorised access and other illegal activities to products and services
- To request questionnaires regarding the function, performance, quality, etc. of products and services
- Proposing business improvements to you based on analysis of the usage of our products and services
- To inform usage status of products and services by individual users based on the request from the administrator of corporate customers or the representative when one software license can be used by multiple customers.
- To verify your identity, confirm the situation, and notify the results when you wish to exercise your rights.
- Fulfillment of obligations as a supplier of products and services stipulated by laws and regulations in each country.
If you do not wish to provide us with Personal Information, we may be unable to properly provide you with the products, services, information and/or warranties that you may require.
4. Use of cookies
When you visit our Site, you can browse and access information without revealing your identity. To improve our Site, we use "cookies" to track your visit. A cookie is a small amount of data that is transferred to your browser by a Web server and can only be read by the server that gave it to you. It functions as your identification card and enables FBNZ to record your user journey. It cannot be executed as code or deliver viruses. Cookies help us to improve our Site and to deliver a better and more personalised service. Cookies enable us:
- To estimate our audience size and usage pattern.
- To store information about your preferences, and so allow us to customise our Site according to your individual interests.
- To speed up your searches.

However, if you select this setting, you may be unable to access certain parts of our Site. 5. Legal Basis of Processing Personal Information
We rely on the following legal bases for the processing of your Personal Information according to applicable laws, including:
- 4.1 Statutory obligation: When processing Personal Information, we act at all times within the Act, and any other applicable statute(s) in the jurisdiction set out in section 18 of this Privacy Policy.
- 4.2 Contractual obligation: When processing is necessary for the performance of a contract to which you are party, or in order to take steps at your request prior to entering into a contract.
- 4.3 Consent: When you have given consent to the processing of your Personal Information for one or more specific purposes (consent as described in this Privacy Policy).
- 4.4 Legitimate Interests: Other than the above, when prescribed by applicable laws, we may rely on legitimate interests (or any other relevant interests) where processing is necessary for the purposes of the legitimate interests pursued by us or by a third party.
When we rely on this legal basis, we may carefully assess whether such interests are not overridden by the interests or fundamental rights and freedom of yours.
6. Security
We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.
Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your data, we cannot guarantee the security of your data transmitted to our Site by you; therefore, any transmission is at your own risk. Once we have received your data, we will use strict procedures and security features to try to prevent unauthorised access.
7. Privacy breaches
A privacy breach occurs where there is an unauthorised or accidental access to, or disclosure, alteration, loss, or destruction of, Personal Information held by us or an action that prevents us from accessing Personal Information on either a temporary or permanent basis.
If we learn of a privacy breach involving Personal Information we hold, we will assess whether the privacy breach is likely to cause serious harm to an affected individual or individuals. If our assessment finds that the privacy breach has caused serious harm to an affected individual or individuals, or is likely to do so, we will notify the individual or individuals and the Privacy Commissioner within the timeframes prescribed by the Act.
8. Storage of data
We use third party service providers to assist in storing and processing certain types of Personal Information for us, and some of these service providers may be located overseas, or use facilities located overseas to provide us with services.
We may share your Personal Information with the following recipients:
- With our affiliated entities (FUJIFILM Holdings Corporation and its group entities).
- With processors such as vendors, consultants, marketing and advertising partners, and other service providers who need access to such Personal Information to carry out work on our behalf or to perform a contract we enter with them
- With third parties with whom you choose to let us share your Personal Information, for example other apps or Websites that integrate with our API
- With financial institutions, etc. (in order to settle the charges for products and services purchased by the customers)
- In response to a request for information by an authority or government entities if we determine that such disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process
- Other recipients which you have consented to sharing your Personal Information with.
FBNZ will ensure that any Personal Information transferred to any third party will be done in accordance with best industry practice, with adequate privacy controls and security, and handled in line with this Privacy Policy.
If FBNZ changes any third parties that handle FBNZ’s and the Customer’s PII, it will ensure that the third party has adequate privacy controls and security and FBNZ will use all reasonable endeavours to notify the customer of the change in third party Personal Information processor.
9. How long do we keep your Personal Information for?
We retain Personal Information for as long as it is needed to be able to provide our services to a customer or corporate business partner. Once our services have been provided, we will only keep data if it is necessary or required to meet legal or regulatory requirements, fulfil our contractual obligations, resolve disputes, or to prevent fraud or abuse. After this point, FBNZ commits to safe and secure disposal of the Personal Information.
10. External sites
Our Site may contain links to other sites. Please be aware that FBNZ is not responsible for the privacy practices of such other sites. You should check the privacy practices of those third-party sites for oversight on how those third-party sites collect and use Personal Information. Links from a FBNZ website to any of those third-party sites does not amount to an endorsement by FBNZ of any of those other websites or their content.
11. Social media platforms
Please be aware that if you share any of your Personal Information on a third-party social media website or app (e.g. Facebook, Instagram and LinkedIn), your Personal Information may be collected or used by the third-party website or app and/or the users of these platforms, and could result in you receiving unsolicited messages. We encourage you to review the privacy policies and settings of the social media platforms you interact with.
12. Who we may share your Personal Information with
We may disclose or share your Personal Information with third parties in the following circumstances:
- Our group companies. We may disclose your Personal Information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries.
- With your consent. We may share Personal Information with third parties where you have consented or requested us to do so.
- Third party service providers. We may share Personal Information with companies that support our Platform and our Services, including any person that hosts or maintains any underlying IT system or data centre that we use to provide our Site or Services.
- Legal obligation or to enforce our rights, prevent fraud and for safety. To comply with any legal obligation, or to protect the rights, property, or safety of our employees, our customers, or others, and includes the reporting of data breaches to affected individuals and the Privacy Commissioner where required by the Act. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
13. Disclosure of Personal Information overseas
We may disclose Personal Information to our related companies in Japan and Singapore. Our related companies in Japan and Singapore are subject to privacy laws that overall provide comparable safeguards to those in the Act. For the avoidance of doubt, FBNZ will not disclose Personal Information to another jurisdiction that does not have overall comparable safeguards to those in the Act.
14. Communications with you
You have the right to ask us not to use your Personal Information for marketing purposes. We will inform you (before collecting your Personal Information) if we intend to use your Personal Information for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain “opt out” boxes on the forms we use to collect your Personal Information. 15. Access to information
The Act gives you the right to access Personal Information held about you so that you can update or correct it. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee to meet our costs in providing you with details of the information we hold about you.
16. Changes to our Privacy Policy
FBNZ reserves the right to change, amend or update this Privacy Policy. We will post the Privacy Policy after the change and specify the date of revision. Please remember to review the Privacy Policy occasionally which may have changed from time to time. Any changes we may make to our Privacy Policy in the future will be posted on this page.
17. User Registration
This service is provided only for the customers in New Zealand. Those who are outside of New Zealand cannot carry out user registration nor use the services in principle.
18. Law
Our Privacy Policy is governed by the laws of New Zealand, and you submit to the jurisdiction of the New Zealand courts.
19. Controller of Personal Information and Chief Privacy Officer
The Act prescribes that a company must appoint as a privacy officer, one or more individuals whose responsibilities include ensuring that the company complies with the Act. The Chief Privacy Officer for FBNZ is as follows:
